User Agreement

We welcome you to PreOwnedCar.com

This is a service we provide to you at no cost to you. We work on a tight budget, limited resources and count on your help and support.

By using the services on this site, you agree to the following terms with PreOwnedCar.com as well principles behind it.

Before you use this site, you must read, understand and agree to this User Agreement as well as the Privacy Policy. The agreement applies to all parts of this website. If you do not agree to this agreement and/or our Privacy Policy. Please do not use this site.

We reserve the right to update this Agreement to address other legal concerns that may arise in the future. Should we make changes to this Agreement, we will post prominent notice of the changes on the site.

While using our site – You will not:

  • post content or items in an inappropriate category or areas on the Sites;
  • violate any laws, third party rights, or our policies such as the Prohibited and Restricted Items policies;
  • use the Sites if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Sites;
  • interfere with other user's listings;
  • post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
  • distribute or post spam, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm PreOwnedCar.com, or the interests or property of PreOwnedCar.com users;
  • copy, modify, or distribute content from PreOwnedCar.com and PreOwnedCar.com's copyrights and trademarks; or
  • harvest or otherwise collect information about users, including email addresses, without their consent.
  • will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.
  • wire money to anyone via western union or like (most likely scammers).
  • take payment by Money orders and check (Fake ones are easy to come by – banks will hold you responsible even after cashing them).
  • give out your financial information (SSN, Bank Accounts, PayPal account or like).

Rules for Dealers

We provide the site to post your ads for free. We feel dealers have a place and provide value addition in market place. Our primary goal is to provide owners with a venue for selling their vehicle direct to buyers. Dealers posting on this site must abide by the following rules:

  1. Please clearly identify yourself as a dealer to give users options to choose a dealer ad or an owner ad
  2. Do not post blanket flyers about dealership or sale or like.
  3. Post a single vehicle per ad; Do not bunch up multiple vehicles into same ad.
  4. Unless its a real show car - avoid posting in ShowCase - that area is for users to post cars for everyones pleasure rather than for sale per se.

We reserve the right to edit or remove dealer posted ads and Showcase vehicle cards that violate these rules.

Abuse

  • We count on your help to keep the site working properlyand the community safe. Please report problems, offensive content, and policy violations to us.
  • Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep users off the Sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts.

Content License

  • When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. (We need these rights to host and display your content.)

Liability

  • You acknowledge that we are a venue to allow anyone (including thieves and other unsavory characters) to offer, sell, buy or post anything, at anytime, from anywhere.
  • You will not hold us responsible for actions or inaction of other users, including what they post.
  • We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of users to sell items or buyers to pay for items, or that a buyer or seller will actually complete a transaction.
  • You will exercise caution and due diligence in dealing with other users.
  • Further, we do not guarantee continuous or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Site.
  • You will indemnify and hold us (and our officers, directors, agents, subsidiaries, employees and contractors), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
  • Please deal locally with people you can meet – with due diligence and caution for your safety.
  • Never wire money to anyone via western union or like – most likely scammers.
  • Avoid taking payment by Money orders and check (Fake ones are easy to come by – banks will hold you responsible even after cashing them).
  • You will not post your financial information (SSN, bank accounts, PayPal accounts and such)

Regardless of all the above, if we are found to be liable, our liability to you or anyone else is limited greater of total of all the fees you paid us (zilch) and 100 USD.

Trademarks

  • PreOwnedCar.com and the PreOwnedCar.com Logo is a trademark of CyberVeda, Inc.
  • All other trademarks appearing on this website or used in the descriptions and titles of ads posted by users are properties of their respective trademark owners.
  • This site is no way affiliated or related with any car manufacturer or dealer.

Prohibited Items

We prohibit the following items from being posted on PreOwnedCar.com:

  • Stolen vehicles.
  • Vehicles currently impounded. (e.g., vehicle is being used as evidence in an investigation of a crime)
  • Vehicles that are not considered street legal.

We reserve the right to remove any ads that we deem inappropriate for this website.
